PA Gaming Control Board To Hold Hearing On Foxwoods Casino Petition

HARRISBURG: The Pennsylvania Gaming Control Board today announced that it will hold a hearing on Friday, August 28, 2009 to consider the petition of Philadelphia Partnership and Development Corporation (Foxwoods) which seeks additional time to make slot machines available to play.

The Board issued the Foxwoods license on May 29, 2008.  On May 22, 2009, the Foxwoods' ownership group filed its petition for an extension of time to commence operation for up to an additional twenty-four months.

Section 1210(a) of the Pennsylvania Race Horse Development and Gaming Act requires that a slot licensee  ". . .shall be required to operate and make available to play a minimum of 1,500 machines at any one licensed facility within one year of the issuance by the board of a slot machine license unless otherwise extended by the board, upon application and for good cause shown, for an additional period not to exceed 24 months."

The Board meeting is open to the public and will begin at 10:00 am in the North Office building, Hearing Room 1, located at the corner of Commonwealth Avenue and North Street in Harrisburg.

The hearing is for the purpose of providing Foxwoods' the opportunity to establish good cause for the extension and to answer any questions the Board members may have regarding the matter.

The Board has procedures through which a licensee may request relief from the Board with respect to some aspect of its license or conditions.  In this case, as a result of Foxwoods' request for the extension, the Board's various Bureaus have examined the matter and the Office of Enforcement Counsel will be prepared to address the Board at the hearing scheduled for Friday, August 28, 2009.

It should be noted that the Foxwoods' petition being considered by the Board only seeks an extension of time and does not involve a change in location for the proposed casino.
