PA Gaming Control Board Issues Statement On Withdrawal of Criminal Charges Against Licensee Louis A. DeNaples
HARRISBURG, PA: The Pennsylvania Gaming Control Board issued the following statement on today’s announcement by Dauphin County District Attorney Edward Marsico that perjury charges against Louis A. DeNaples, principle licensee of Mt. Airy Casino Resort, have been dropped:
Based on the Dauphin County District Attorney Statement announcing the agreement for the withdrawal of charges against Mt. Airy #1 LLC principle licensee Louis A. DeNaples, the Board will discuss and evaluate the effect of this decision on the status of its suspension order, which stemmed solely from the original filing of the charges, at its April 22nd meeting.
All changes in ownership must go through the established administrative process prior to being considered by the Board. Regarding any changes in ownership structure of this slot machine license, the Board will evaluate any petitions pending or which may be presented and make a determination whether relief should be granted based upon the record.
The suspension order previously issued by the Board in early 2008 suspending Mr. DeNaples’ license and placing conditions on him remains in effect until otherwise ordered by the Board.
Background
• The Office of Enforcement Counsel requested, and the Executive Director executed a temporary emergency order of suspension on Mr. DeNaples’ principle license on January 30, 2008 based on the filing of criminal charges by the Dauphin County District Attorney.
• On January 31, 2008, the Office of Enforcement Counsel filed a petition for an emergency order to impose conditions upon the license of Mt. Airy #1, LLC which defined obligations and oversight measures for the operation of the casino during the period of suspension of Mr. DeNaples. This order was also approved by the Executive Director.
• The Gaming Control Board approved the suspension of Louis A. DeNaples on February 5, 2008 with a number of conditions and the appointment of Dr. Anthony F. Ceddia as Trustee to serve and report to the Board in Mr. DeNaples absence.
